A 40-year-old man found with a 1,400-plant cannabis grow-op just before recreational cannabis was legalized three years ago could be spending the next year in jail.

The year-long term is a minimum sentence for the count with an aggravating factor, such as the offence being for the benefit of a criminal organization, involving use or threat of violence, involving use or threat of use of weapons or representing abuse of authority or position, according to the Public Prosecution Service of Canada.

Nguyen reportedly previously held a Health Canada licence, but gave it up in 2013. Since he was well aware of the regulations in place, which was seen as an aggravating factor, according to Castanet Kamloops.

The jail term for the charge Nguyen pleaded guilty to could increase to two years if a different set of aggravating factors are involved. These include if the offence occurred in or near a school, its grounds or an area normally frequented by those under 18 or was in relation to a youth.

Despite the legalization of recreational cannabis, it remains illegal for an adult to grow more than four plants for personal use or to sell weed without being properly licensed.

“You may not sell the cannabis you grow at home to others,” notes information from the Government of Canada. While plants grown at home are limited to four per household, “some provinces and territories have applied added restrictions on personal cultivation.”

It is not known where the cannabis was being sold, but the RCMP issued an advisory this summer that people should not buy weed from illegal sources. Doing so helps to puts guns and cash into the hands of criminals, police noted.
